Judge denies defense requests for upcoming capital murder trial

Early Friday afternoon (Jan. 4) in 355th Judicial District Court, Judge Ralph Walton ruled that DNA evidence collected from Justin Wade Ragan of Granbury could not be barred from his trial. Ragan is one of three people charged with capital murder in the Jan. 17, 2012, shooting death of Gene Sabin at T.J.’s Private Club and Cafe. Walton also denied a continuance request for more preparation time from attorney Cole Bryan of Fort Worth in his defense of Ragan, who will be tried separately from the other two defendants, Kimberly Danielle Milwicz and Gordon Ray Lewis. District Attorney Rob Christian is not seeking the death penalty against Ragan. Jury selection for Ragan’s trial is scheduled to start on Monday, Jan. 28.
