August 24, 2013

A 32-year-old Tolar-area man who is accused of having a lewd photograph of a 4-year-old girl was arrested Aug. 15 at his home, according to a felony criminal complaint.

The suspect, Jonathan Daniel Kutej, had gone out to have drinks on Aug. 14 with the mother of the child.

When they returned to the woman’s home, the defendant “had access” to the child while the mother went to the bathroom, the complaint states.

Later the woman became suspicious of Kutej and looked at pictures on his phone, the complaint continued. She told an investigator with the Hood County District Attorney’s Office that she saw four photos of her sleeping daughter.

“The fourth picture depicts (inappropriate touching),” the complaint says.

She forwarded one of the pictures to her phone and later showed it to the investigator, the complaint states.

If convicted, the penalty range on the second-degree felony count would mean a prison sentence from 2-20 years, and a fine as high as $10,000. Kutej was released from the Hood County Jail on Aug. 16 after posting $75,000 bond.
